§ 393.40. Certain persons prohibited from possession.

It shall be unlawful for any person within the corporate limits of the city to possess,
carry or have in his custody or control any weapon if such person shall be a person
prohibited from possession of a firearm pursuant to Minnesota Statutes or federal
law. A person prohibited from possession by reason of age alone may possess weapons
under the circumstances enumerated in section 393.70(a). It shall be an affirmative defense to a charge pursuant to this section, if defendant
proves by a preponderance of the evidence that he possessed the weapon solely as a
tool in connection with, and in the course of, lawful employment. (Code 1960, As Amend.,
