§ 426.50. Conflict of interest.

  • A commissioner who has a potential conflict of interest shall not take part in the action or decision in question; provided, however, that a commissioner who is a resident of the Little Earth Project shall not be deemed to have a conflict of interest in a matter unless the commissioner has a personal financial interest in the matter different than the financial interest of other Little Earth residents. A commissioner of the MIHA who is authorized to take part in any manner in making any sale, lease or contract in his official capacity shall not voluntarily have a personal financial interest in that sale, lease or contract or personally benefit financially therefrom. A commissioner of the MIHA who violates this subdivision is guilty of a gross misdemeanor. For a period of one year after termination of his or her position as a commissioner of the MIHA, no former commissioner shall appear personally before any court or governmental department or agency as agent or attorney for anyone other than the MIHA in connection with any proceeding, application, request for ruling or other particular matter in which the MIHA is substantially interested, and with respect to which the commissioner took any action or made any decision as a commissioner of the MIHA at any time within a period of one year prior to the termination of such position. This section shall apply in regard to conflict of interest notwithstanding any other provision of law. (90-Or-259, § 1, 10-26-90)
