§ 113.40. Encroachment into public property.

  • No portion of any retaining wall hereafter erected shall encroach upon or project into any street, alley, park or other public property without the owner first obtaining a special council permit. The owner of any such retaining wall which projects or encroaches upon any public property shall remove at once any part or all of such encroaching portions of such wall upon being ordered to do so by the city council.
