§ 16.800. Definitions.

  • For the purposes of this article, the terms defined in this section shall have the following meanings:

    Attorney's fees: Fees deducted from workers' compensation benefits obtained for an employee through an attorney's representation or otherwise payable pursuant to Minnesota Statutes, Ch. 176.

    Burial expense: That expense described in Minnesota Statutes, Section 176.111.

    Claim expense: Expenses incurred in determining the facts or disposition of a claim or loss, in evaluating the extent of disability, in monitoring a claim, or in connection with any legal proceeding relative to a claim; any interest or penalty assessed pursuant to Minnesota Statutes, Chapter 176.   

    Current bills incurred by the city arising out of worker's compensation employee claims: All claim expense and other current obligations for workers' compensation claims, payable pursuant to Minnesota Statutes, Chapter 176, including but not limited to temporary partial disability, temporary total disability, permanent total disability and permanent partial disability expenses, burial expense, dependent allowances, supplementary benefits, rehabilitation expense, remodeling of residence expense, treatment, appliance and supply expense and attorney fees.

    Dependent allowances: Workers' compensation benefits for dependent survivors of deceased employees as described in Minnesota Statutes, Chapter 176.

    Employee: All city employees, subject to mandatory coverage under Minnesota Statutes, Chapter 176. Employee, pursuant to the provisions of Minnesota Statutes, Section 176.011, subdivision 9, shall also include all full-time, salaried, elected and appointed officers of the city, elected or appointed for a regular term of office or to complete the unexpired portion of any such regular term.

    Permanent partial disability: Workers' compensation benefits for permanent impairment of bodily function, as described in Minnesota Statutes, Chapter 176.

    Permanent total disability: Workers' compensation wage loss benefits, as described in Minnesota Statutes, Chapter 176.

    Rehabilitation expense: Workers' compensation benefits for retraining or rehabilitation, as described in Minnesota Statutes, Chapter 176.

    Remodeling of residence expense: Workers' compensation benefits for the physical accommodation of handicapped employees, as described in Minnesota Statutes, Chapter 176.

    Supplementary benefits: Workers' compensation benefits supplementing wage loss benefits, as described in Minnesota Statutes, Chapter 176.

    Temporary partial disability: Workers' compensation wage loss benefits for employees earning less than pre-injury wages, as described in Minnesota Statutes, Chapter 176.

    Temporary total disability: Workers' compensation wage loss benefits, as described in Minnesota Statutes, Chapter 176.

    Treatment, appliance and supply expense: Workers' compensation benefits for curative treatment, as well as related supplies and appliances, as described in Minnesota Statutes, Chapter 176. (82-Or-235, § 1, 11-24-82; 89-Or-212, § 1, 10-27-89)
