Whenever the owner or occupant of any lot fronting upon or adjoining any street of
which a grade shall not have been established, shall not be able, from the nature
of the ground, to have convenient ingress to and egress from the lot to the street,
the owner or occupant shall be permitted to fill up or excavate the street adjoining
such lot or lots, in such manner as shall give convenient access to the same, provided
that the same be done without prejudice to the public right-of-way in or over said
