§ 360.15. Licensed premises.

  • (a) For any license or permit issued under this title, except hotels, the physical space included in the licensed premises shall be limited and determined in accordance with the following conditions:

    (1)

    The licensee must be the exclusive operator of the entire licensed premises, which must be operated as a single business entity with the same hours of operation. If more than one trade name or logo is used to designate different areas, those trade names or logos must have something in common to suggest single ownership of the premises.

    (2)

    The licensee may not lease or contract out a part of the physical space of the licensed premises to a separate individual or entity to be operated as a separate unit.

    (3)

    The physical space of the licensed premises must be compact and contiguous. All areas of the licensed premises which are open to the public must be connected by passageways which are open to, commonly used by, and readily accessible to customers without leaving and reentering the premises.

    (b)

    For any license issued under this title to a hotel, including a business licensed as a hotel under Chapter 297, and meeting the definition of hotel in Chapter 360 except for the requirement of having fifty (50) rooms, the physical space included in the licensed premises shall be limited and determined in accordance with the following conditions:

    (1)

    The licensed premises shall include only those food and liquor service areas designated in the license application and actually owned and operated by the hotel. Provided, the license shall permit a maximum of three (3) public restaurants and bars, owned and operated by the hotel, under one hotel license. The licensed premises shall not include restaurants and other areas leased or contracted out to independent operators.

    (2)

    The license shall permit liquor service in hotel rooms only in accordance with this title and other applicable laws. (86-Or-277, § 1, 12-19-86; 89-Or-007, § 1, 1-27-89)
