§ 349.10. Definitions.

  • For the purpose of this chapter, the following words and terms are defined and shall be construed as hereinafter set forth unless it is apparent from the context that they shall have a different meaning:

    Class A motor vehicle service shall mean the removing of a motor vehicle by towing, carrying, hauling or pushing from private property at the request of a person who is neither the owner or operator nor agent of the owner or operator of the vehicle.

    Class B motor vehicle service shall mean the using of a service vehicle for the purpose of towing, carrying, hauling or pushing at the request or authorization of the owner, operator, or agent of the owner or operator, of the vehicle receiving service for remuneration or compensation of any kind, including the business or activity of buying or receiving motor vehicles and using a service vehicle for the removal or taking away of such vehicles.

    Class C motor vehicle service shall mean the starting or attempting to start another motor vehicle through utilization of any type of electrical device or battery for remuneration or compensation of any kind.

    Class D motor vehicle service shall mean the towing, carrying, hauling or pushing upon public streets of another motor vehicle, without remuneration or compensation of any kind, by a vehicle having equipment or any modification especially designed for towing, [carrying, hauling] or pushing.

    Class E motor vehicle service shall mean the removal of a motor vehicle by towing, carrying, hauling or pushing from public or private property when such vehicle has been ordered to be impounded in accordance with Article X, Minneapolis Traffic Code or has been determined to be abandoned in accordance with Chapter 168B of the Minnesota Statutes.

    Service vehicle shall mean any motor vehicle which is designed to or does provide any type of service, including but not limited to, towing, [carrying, hauling or] pushing, or car starting as described in any of the classifications in this section, except that vehicle transports or multicar hauling vehicles capable of carrying or hauling four (4) or more vehicles shall not be construed to mean service vehicles for the purpose of this chapter.
