§ 232.20. License required.

  • (a) Prior to the operation of any tanning facility used by the public for a fee or other compensation, the owner or operator shall file an application with the department for a license to operate such facility. The application shall be on a form prescribed by the department and include the following information:

    (1)

    Applicant's (owner) name, address and telephone number.

    (2)

    Name of tanning facility, address and telephone number.

    (3)

    Type and year of manufacture of equipment proposed to be used for such tanning services.

    (4)

    Primary function of the business in which the tanning facility is located.

    (b)

    Fees: A license fee shall be submitted with the application to the department in an amount as established in Appendix J, License Fee Schedule.

    (c)

    If the owner or operator owns or operates more than one such tanning facility, the owner or operator shall file a separate application and fee for each facility owned or operated.

    (d)

    Within thirty (30) days of receipt of such application, health department personnel shall complete the initial inspection of the premises of such tanning facility and ensure that the premises and the tanning facilities are installed and will be operated in accordance with this chapter. Facilities operating at the time of enactment of this chapter must promptly apply for licensing and may continue operation during the period of inspection.

    (e)

    Upon submission of the application and the license fee, and if the initial inspection of the premises indicates that the premises and the tanning facilities are properly installed and will be operated in accordance with this chapter, the department shall issue a license to the owner or operator.

    (f)

    The license issued by the department shall be renewed each year on or before October first. The license is valid only for the location stated on the license and is not transferable.

    (g)

    The license shall be displayed in a conspicuous place on the premises of the tanning facility.

    (h)

    In the event of a change of ownership, the new owner will be required to apply for a license to own and operate such a tanning facility within thirty (30) days after taking possession of the property.
