PB7-8. - Building materials and obstructions on parkways.

  • No person shall encumber or obstruct or cause to be encumbered or obstructed, any parkway or part thereof, by placing therein or thereon, any building materials or any article or thing whatsoever, including waste receptacles or storage units. Provided that if any building is under construction so near to a parkway that the construction cannot well be carried on without depositing building material temporarily in the parkway, an application may be made to the park and recreation board for leave to deposit material stating the circumstances of the case, the portion of the parkway which it is desired to occupy, the kind and quantity of materials to be placed thereon, and the length of time which they shall remain, and thereupon the board may, unless in its judgment the public interest will be injured, authorize a permit to be issued for so depositing materials, and in case a permit is authorized by the board, the secretary shall issue such permit, which shall contain provisions requiring the holder to confine materials to the designated portion of the parkway, to remove the same within the time specified and to replace all turf, shrubbery and other improvements which may be injured, and leave the same in as good condition as before; to keep such material guarded during the daytime against falls and accidents, and to place red lights thereon from sunset to sunrise of each night. The person receiving the permit shall endorse thereon an agreement to comply with all the conditions of the permit, and to save the park and recreation board and the city harmless from any loss, damages or liability which may directly or indirectly result therefrom.
